Let me reiterate that the purpose of segwit2x and NYA agreement isn't to prevent a hardfork (quite the contrary that's the very second term in the link I gave above), it is to prevent a chain split. Now you think a hardfork == a chainsplit you are mistaken.
I encourage you to do some critical thinking here on this. If you cannot explain in what way the code is violating this agreement, how do you know the source you are referring to isn't misleading you?
