I cannot see how they could do this, nothing to stop a miner from going in buying a single card and then going back and buying another.
What are they going to do, go round your house and make sure you're putting the card in a gaming PC and not a mining rig?
Also a gamer is not going to buy a lesser gaming card because their gameplay might suck.
On the other hand, a miner will do the sums and they know that they can still turn a profit with a lesser card. Also a miner will look after the card a lot better, sure they'll be overclocked but won't be under the same stresses trying to load graphics.
Also if a miner does burn out a card it's going to hurt them in the pocket.

Not sure how they can stop people buying as many cards as they want online, from eBay, Amazon or even Alibaba, to name a few, best of luck with that idea, it is dead in the water from day 1.
