Treating a large percentage of the population as criminals will lead to civil war and the destruction of the society engaging in such immoral behaviour.
If you are going to be branded a criminal merely for asserting your right to determine what is stuck in your body, then many people will decide for armed rebellion.
A society cannot survive even 5% of its population in armed rebellion, let alone 30% or 40% or 50%.
