Hitting a 30-year low in 2012, the rate of positive drug tests among American workers is less than 5%. As legalization of medicinal and recreational marijuana pushes forward however, 86% of employers are concerned about its influence reaching the workplace. Though drug tests do little to impact illegal drug use overall, it has its own benefits in a professional environment.
Among employers, 86% say they worry that legalization of marijuana will increase their operating costs through more workers’ comp claims and even possible litigation issues. But it’s not just about the costs; employers who drug test do so in order maintain a healthy and safe professional environment. Strict privacy laws protect the rights of employees, while also keeping the safety interests of employers in mind. As a result, it’s important for all parties to know and understand their rights, from employees knowing when and how to dispute results to employers understanding the limitations of the results they can discern.
