That is why a Russian expert in the field of family law, Julia Meshkov commented on the most common parental fears about CPS and told about the parents` rights. Maybe some of her answers will be helpful also to people of other countries.
1. What happens if a child complains about me on the hotline for the fact that I punish him for bad marks?
- Psychologists work on the hotlines, and the purpose of this hotline is psychological help. Employees of the service can call the police or social workers at the child's request if the child complains that you are beating him or, say, depriving him of food as punishment.
2. I'm afraid that my children will be taken away, since I am a single mother and do not earn much.
- If the life and health of your children is not threatened, no one is allowed to take them.
3. - If the representatives of CPS come to my home with a check-up, when I'm at work, and see what kind of disorder there is, can they on this basis conclude that I'm a bad mother?
The conclusion is not made on the basis of a one-time visit, this is a comprehensive measure: the physical and psychological health of children is assessed, and many other factors. Secondly, tell the children not to open the door to others when you are not at home. Noone will hack it, the inviolability of the home is guaranteed by the Constitution.
4. - We do not have a grandmother and nanny, so a first-form son often remains at home alone, can this be used by officials against us?
If the child does not remain alone in a closed apartment for a long time, then there should not be problems, in addition, try to get him into the extended - day group at school.
5. - The son has a peculiarity of the body: after the slightest blow marks remain on his body, and he constantly hits all the corners in the apartment. What if they decide in school that I beat a child?
- You need to get a certificate from the doctor about the features of the child's organism and on the questions of teachers or social workers to show it and explain the situation.
6.- Our daughter has dyslexia and dysgraphia, but we have no money for a speech therapist. Can the representatives of CPS conclude on this basis that the child is stunted through our fault?
- In our country there is so far a "shareware" medicine. If the doctor makes such diagnoses, then he is obliged to treat, for example to make referrals to a speech therapist to a district clinic or to a special center, and there are also specialized educational institutions for such children. If you used all these opportunities, they have no right to accuse you of something.
7. - The representatives of CPS say that children should not go on a fast, otherwise social services can withdraw a child.
- As far as I know, even according to church canons, fasting is allowed not to be observed by children, pregnant women, old people and patients. As for the law: if these compulsions harm the child's health, both physically and psychologically, social workers may intervene in such a situation.
I have already made a post about how to protect yourself from the representatives of CPS. Now I would like to add some tips.
You should also tell the children not to give anyone information about your family; prohibit questioning of children at school; warn teachers that you do not give permission to collect information about the family and the child, you need give a statement to the school or kindergarten about it. Currently, schools are actively collecting personal data from both schoolchildren and their families to create complete automated dossiers for all citizens. Any information that is collected about us, can always serve as an occasion for making claims to the family.
The data is often collected under pressure on children: "The teacher said that if we do not consent to the collection and processing of our data, the child will begin to have problems." You need to know how to correctly formulate a statement, a request and how to prove the legality of your refusal. If possible, conflicts should be avoided, politely and firmly justify your refusal, referring to existing legislation.
Conduct a conversation with the child. Children should know that they should not tell anyone anything about the family! No social educators, psychologists, etc. Even an essay on the topic "My family", "How I spent a vacation or a weekend" can become a source of information that can negatively affect your family. Therefore, it is necessary to explain to the child what consequences can be, if he will be frank or, God forbid, complain about his parents.
You should always remember: help others - and they will help you. If you are alone, it is always difficult to fight off, so you need to know in advance where to turn in case. The simplest version is a group of familiar parents with audio and video equipment that agree on mutual assistance. Each parent must have such an agreement. After reading these recommendations, immediately create such a rapid reaction group among friends. It is even better to create a parent committee for the protection of family rights in the temple, at the place of work or residence.
In every city, village parents must organize such a committee, which will not allow to take root for juvenile lawlessness in our locality. If suddenly there are problems, then following the call everyone who has an opportunity at the given moment, should go to protect the family. For example, if the children were taken from the school - they should go to the shelter or hospital to return the child; or if CPS came home, then such a commitee should go home; or to the criminal police, the prosecutor's office, etc. The principle of juvenile justice is at first to withdraw the child, and then to understand what happened, so it is important to immediately get the child back, and then to prove that everything is in order.
Ideally, such a committee should have journalists, lawyers, psychologists, etc but it will be enough noisy moms and serious dads at the start.
Do not let the officials shout at yourself: to yell at parents so that they feel guilty is a favorite reception for the juveniles of the whole world. They often protect their iniquities with rudeness and insults. Therefore, you should have a firm position: "I will not talk in this tone! Calm down, and then we'll continue the conversation. " Any official as if by magic becomes polite, as soon as you get a recording device (or video camera) that you have the right to use, because you are pressured and insulted.
I hope these tips will help you to get prepared if the representatives of CPS will try to withdraw your children. Remember that knowing your rights is a strong weapon in struggle for your kids.
