Thank you for addressing my question. I had overlooked that it would not be effective until 2023 which is a lot of time for them to change or clarify the law even further.

The answer to your question is that any staked SPT tokens count towards that airdrop points. I would delegate it out if you haven't been actively looking for the SPT content.
