On February 5th, 2025, North Carolina Senators filed Senate Bill 58, which would limit the powers of the North Carolina Attorney General.
The relevant section of SB 58 read:
9 "§ 114-2.8. Limitation on participation in foreign certain litigation.
10 The Attorney General shall not, as a party, amicus, or any other participant in an action
11 pending before a state or federal court in another state, advance any argument that would result
12 in the invalidation of (i) any statute enacted by the General Assembly.Assembly or (ii) any
13 executive order issued by the President of the United States."
