There are generally two types of license for royalty-free images. Editorial and commercial. Editorial licenses give a limited set of rights. You can usually use it in things like ads or blog posts, but not in things you intend to resell. Commercial licenses...the entire point is to be able to resell the things you create with things purchased under this type of license. The fees are higher for commercial licenses than editorial ones for this very reason. So in my mind the question will come down to: did they pay for the (more expensive) commercial license, or didn't they? If they did, then they're in the clear. The thing they're creating with the images is the game. The NFTs are part of the game. Pretty cut-and-dried, really. Nothing illegal or immoral about using an image in the way it was specifically licensed to be used. I truly don't get the fuss here.

The 5 different platforms have different agreements. Not all of them offer an editorial and a commercial license.
Some just say that you can't re-sell them.

Update: they admitted their wrongdoing and they will replace them.
