Section 14.3 of the agreement signed with AAX prevents the creation of a class action. The lawyer studied the Terms and Conditions and concluded that: “AAX has no right to restrict the action of users in case AAX commits a crime”. Class action is possible and all users of the world can participate.
We spoke to the lawyer Antonio del Vecchio for the second time to ask what strategy he will adopt. The strategy depends on whether users will be reimbursed and whether AAX executives will go to jail. Here's what he told us.
Asset Freezing
The first legal action will be to freeze users' assets so they can't be used by AAX to pay off creditors or turn them into dollars. This will be done by blacklisting them as specified by “Coin marketcap” https://coinmarketcap.com/alexandria/article/how-can-cryptocurrencies-be-frozen-on-a-blockchain
Freezing can only happen by reporting to the authorities the amount of assets stolen from users. The lawyer will give the information to the police who will verify it, calculate the sum and freeze those assets in AAX wallets.
Refund request
Together with the request to freeze users' assets, reimbursement in FIAT will be requested from AAX. If he pays in FIAT, the debt is paid off and AAX can keep the crypto, then users will receive wire transfers to their bank account.
What happens if there is no money in the wallet or bank
The lawyer will seek the seizure of the assets of AAX and its executives to sell and recover the debt, but to do so requires there to be fraud reports in every state that is participating in the class action. Therefore, every user must report AAX as a scam, accusing it of having blocked withdrawals and, without ever restoring them, having closed the website.
AAX executives who have committed an offense will be asked to reimburse users instead of the company
The lawyer will ask the police to verify the behavior of the managers. All executives who have committed an offense will be asked to reimburse users. If they choose not to refund or have already spent the money, they will be prosecuted by law which could charge them with a criminal offence.
AAX may file for bankruptcy
If AAX declared bankruptcy, the class action participants would automatically become creditors of AAX. The company will initiate bankruptcy proceedings and pay with the remaining money. Managers will be asked to pay the remaining amount as described in the paragraphs above.
The civil and criminal case
If AAX does not have the money to reimburse users, a civil suit will be filed to seek reimbursement from AAX executives.
If the police confirm the criminal offense, a criminal case will be held to send AAX executives to prison.
The two cases will be carried out in Seychelles by a lawyer from Seychelles (the state of registration of AAX). The Italian lawyer will collaborate with the Seychelles colleague, send him all the documentation and pay him.
WARNING: No one will ever know that your money has been stolen, that you have a lawsuit pending and that you are asking for a refund. The Italian state protects your privacy.
Case where users will NOT be refunded
Users will not be reimbursed if the police, following an investigation, decide that:
- AAX blocked users' money legally
- AAX executives committed no crime when they ordered withdrawals to be stopped
- The bankruptcy is due to problems external to AAX and the executives did what they could to save the company
In all other cases, even if all AAX companies are Limited, the managers will be convicted and the court will decide who will have to repay the money that the company fails to repay and go to prison for the crimes committed
The lawsuit ends and the class action participants are reimbursed: can I join and be reimbursed too?
No. You will need to hire a lawyer and ask for reimbursement (it will cost more). The class action will ask for reimbursement only for the participants.
AAX has become illegal in my state. Can I participate in the class action?

Il punto 14.3 del contratto sottoscritto con AAX impedisce la creazione di una class action. L’avvocato ha studiato i Termini e Condizioni e ha concluso che: “AAX non ha alcun diritto di limitare l’azione degli utenti nel caso sia AAX a commettere reato”. La class action è possibile e tutti gli utenti del mondo possono partecipare.
Abbiamo parlato con l’avvocato Antonio del Vecchio per la seconda volta per chiedere quale strategia adotterà. Dalla strategia dipende se gli utenti saranno rimborsati e se i dirigenti di AAX andranno in prigione. Ecco cosa ci ha detto.
Congelamento degli asset
La prima azione legale sarà il congelamento degli asset degli utenti, in modo da non poter essere usati da AAX per pagare i creditori oppure trasformarli in dollari. Richiesta di rimborso
Insieme alla richiesta di congelamento degli asset degli utenti, sarà chiesto il rimborso in FIAT ad AAX. Se paga in FIAT, il debito è estinto e AAX può tenersi la cripto, poi gli utenti riceveranno dei bonifici sul loro conto bancario.
Cosa accade se i soldi nei wallet e in banca non ci sono
L’avvocato chiederà il sequestro dei beni di AAX e dei suoi dirigenti per venderli e recuperare il credito, ma per farlo occorre che ci siano denunce di truffa in ogni stato che sta partecipando alla class action. Perciò ogni utente deve denunciare AAX di truffa accusandola di aver bloccato i prelievi e, senza averli mai ripristinati, aver chiuso il sito web.
Ai dirigenti di AAX che hanno commesso reato sarà chiesto di rimborsare gli utenti al posto dell’azienda
L’avvocato chiederà alla polizia di verificare il comportamento dei dirigenti. A tutti i dirigenti che abbiano commesso reato sarà chiesto di rimborsare gli utenti. In caso scelgano di non rimborsare oppure abbiano già speso i soldi, saranno perseguiti dalla legge che potrebbe accusarli di reato penale.
AAX potrebbe dichiarare bancarotta
Se AAX dichiarasse bancarotta, i partecipanti alla class action diventerebbero automaticamente creditori di AAX. L’azienda avvierà la procedura fallimentare e pagherà coi soldi rimasti. Ai dirigenti sarà chiesto di pagare l’importo rimanente come descritto nei paragrafi sopra.
La causa civile e penale
Se AAX non avrà i soldi per rimborsare gli utenti, sarà svolta una causa civile per chiedere il rimborso ai dirigenti di AAX.
Se la polizia confermerà il reato penale, sarà svolta una causa penale per mandare in prigione i dirigenti di AAX.
Le due cause saranno svolte alle Seychelles da un avvocato delle Seychelles (lo stato di registrazione di AAX). L’avvocato italiano collaborerà con il collega delle Seychelles, gli invierà tutta la documentazione e lo pagherà.
ATTENZIONE: nessuno saprà mai che ti sono stati rubati dei soldi, che hai una causa in corso e che stai chiedendo un rimborso. Lo stato italiano tutela la tua privacy.
Caso in cui gli utenti NON saranno rimborsati
Gli utenti non saranno rimborsati se la polizia, concluse le indagini, decide che:
1.AAX ha bloccato i soldi degli utenti legalmente
2.I dirigenti di AAX non hanno commesso reato quando hanno ordinato di bloccare i prelievi
3.La bancarotta è dovuta a problemi esterni ad AAX e I dirigenti hanno fatto il possibile per salvare l’azienda
In tutti gli altri casi, anche se tutte le società di AAX sono Limited, i dirigenti saranno condannati e il tribunale deciderà chi dovrà rimborsare i soldi che l’azienda non riuscirà a rimborsare e andare in prigione per i reati commessi
La causa finisce e i partecipanti alla class action sono rimborsati: posso aggiungermi ed essere rimborsato anche io?
No. Dovrai assumere un avvocato e chiedere il rimborso (ti costerà di più). La class action chiederà il rimborso solo per i partecipanti.
AAX è diventata illegale nel mio stato. Posso partecipare alla class action?
Dipende se la polizia perseguirà AAX. Vai a una stazione di polizia e informati se AAX sarà accusata di reato civile o penale e partecipa alla class action in caso affermativo
