President Trump invoked the Alien Enemies Act of 1798 in declaring that all Venezuelan citizens aged 14 years and older are considered unlawful and ineligible for permanent residency in the United States if they are identified as gang members. This prompted the American Civil Liberties Union (ACLU) to file a lawsuit asserting that the application of the Act in this context is unconstitutional and unlawful.

Chief U.S. District Judge James Boseberg ruled in favor of the ACLU, positing that the Alien Enemies Act should not be employed against Venezuelan citizens in this manner, regardless of their alleged gang affiliations. As a result, the deportation of five individuals already in U.S. custody was temporarily blocked.
