As the days passed without communication, Nicole's growing concern led her to contact Brian’s mother, Roberta, on September 10. When she received no response, the situation escalated, prompting public calls for help in locating Gabby.
Following the discovery of Gabby’s remains and the eventual conclusion of Brian's life in September 2021, the Petito family pursued legal action. They filed a wrongful death lawsuit against Brian's estate, which ultimately resulted in a $3 million settlement in 2022. Additionally, a 2024 settlement was reached regarding a separate lawsuit against Brian’s parents for infliction of emotional distress.
