I am less than confident in the 9th and 10th amendments as remedy when it has been the states leading the lockdowns.
yes, it does not bode well, but the counter is that if the fed had the call, its all or nothing. With the way it happened, at least some states never locked down. Another note is that it is easier to overturn a state call than a federal on.
