The Electoral Chamber of the Supreme Court of Justice (TSJ) annulled on Tuesday the student elections held on November 14 at the University of Carabobo (UC), in which Marlon Díaz was proclaimed president of the Federation of University Centers
The ruling, prepared by the President of the Chamber, Indira Alfonzo, declared "non-existent and without legal effect the arbitrary and illegitimate acts carried out by the citizen Luis Eduardo León (president of the electoral commission)".
He added that Leon "proceeded to the proclamation of the citizen Marlon Díaz in the position of president of the Federation of University Centers before the academic authorities of that same house of studies, in usurpation of the attributions of the members of the Electoral Commission legally constituted on November 12, 2018, "added the letter published on the web portal of the TSJ.
The decision was taken by the court, after the student Jessica Bello Barreto, who was a candidate for the board identified with the ruling party, filed a constitutional amparo against the proclamation of Marlon Díaz and the electoral commission, "for the alleged violation of the right to active and passive suffrage, and the right to participation enshrined in articles 62, 63 and 70 constitutional ".
The TSJ ordered "the authorities of the University of Carabobo, perform all necessary and relevant actions in order to ensure the effective possession of the position and the immediate exercise of the functions of the citizen Jessica Bello Barreto", as she stated that she was who "was elected and proclaimed by the student electoral commission legally constituted on November 12, 2018, in the position of president of the Federation of University Centers of that house of studies".
He also ordered "to send a certified copy of this ruling" to the Public Prosecutor's Office "for the purpose of initiating the investigation into the alleged commission of crimes committed in the electoral process."
