For most humans at the moment (especially in America), the answer to both of these questions is "no", at least in a legal sense. People often wonder why the police, NSA, CIA, etc. can do whatever they want to "citizens" without repercussion, and it's simple: If you are a "citizen", then by definition the State you are a citizen of claims ownership of your body. Let's start at the beginning (of life), and lay out how certain parties came to claim ownership of your body, the documents they use, why it matters, and steps you can take to change it.
This is an updated & tweaked version of an article I posted just under three years ago, partially so I could revisit it (as these ideas have been coming up in conversation lately), and partially because most of the people on STEEM now, and following me specifically, weren't on the platform back them.
Some of this you may already be familiar with, much of it will probably be brand new (I know it was for me not long ago). Everything you are about to read is based on the research & experiences of many folks, over the course of many decades now, and which I have spent years sifting through, digesting, discussing, and condensing. Have an open mind, do the research yourself, and sit with it all before letting any "beliefs" cement.
This is not a story of how your power was taken from you, and you are not really owned by the government... but that is what they believe, and unfortunately most Americans unknowingly play along with this story, thus giving up their power. The goal here is to learn about the fiction, so that we can each move outside of it.
Let's get started... with your birth
When you are born in a hospital in the U.S., two important documents are created: a Birth Certificate, and a Certificate of Live Birth. The birth certificate has the name you were given, in all capital letters, as well as a height & weight, and an attached DNA sample (with the original). You might think those measurements and that DNA are yours, but they are actually from your afterbirth (which has a pulse at the time, and is legally considered a child).
Legal meaning of the word child (from US Title Code)
...shall include every infant member of the species homo sapiens who is born alive at any stage of development. As used in this section, the term “born alive”, with respect to a member of the species homo sapiens, means the complete expulsion or extraction from his or her mother of that member, at any stage of development, who after such expulsion or extraction breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut, and regardless of whether the expulsion or extraction occurs as a result of natural or induced labor, cesarean section, or induced abortion.
45 days after you are born, the state claims that afterbirth as an article in commerce, lost at sea. Since the state has possession of that article in commerce, the state creates a trust, with the afterbirth as the surety. This newly-created trust is the person named on the birth certificate, and that name is in all capital letters because that is required for persons.
The legal meaning (from US Title Code) of the word person is:
"the words “person” and “whoever” include corporations, companies, associations, firms, partnerships, societies, and joint stock companies, as well as individuals"
According to The US Supreme Court & Black's Law Dictionary, whenever the word "includes" is used, it means includes only. When you look at laws & statutes in the U.S., you will notice that they only apply to persons. That means not you, and not me; we're humans, natural beings, spirit-filled (wo)men. SO why is it that men & women just like us are being punished for violating those statutes? Simple, they were operating as agents of a person (the trust named on their birth certificate). When a police officer asks for your name and date of birth, and you answer, you are not identifying yourself, you are identifying the person for which you are acting as an agent. The other thing that the state does is register that name as intellectual property. As long as you pay the royalties (taxes) and follow the intellectual property agreements (laws & statutes), the state has no issue with you using their property; it's when you stop playing along with those two pieces that you start to have problems.
Many of you will be familiar with the idea that every American is born over $60,000 in debt. What that comes from is the state going to The Federal Reserve, and taking out loans using the expected income (taxes) from all of those trusts as collateral.
Okay... so I'm not a person and I am not subject to the state's laws; but I thought you were talking about the ownership of my body
You'll remember I said that 2 documents were created when you were born, the Birth Certificate and the Certificate of Live Birth. The Certificate of Live Birth contains what your parents called you (first letter capital, the rest lower-case), as well as a height, weight, footprint, and another DNA sample (again with the original copy). This time, however, those measurements and identifiers are all of your body. This "Certificate of Live Birth" is the ownership document for your physical body, just like the title to a car. Right now, some of you may be thinking "Well ha! I have my Certificate of Live Birth in my safe at home." If you go examine that document closely however (maybe even with a magnifying glass), you will see that it is a copy (usually copy #3). Ever tried to use a copy of the title for a car to sell it or use it as collateral for a loan? You're not going to have any luck, because that copy is not a legal document. The original Certificate of Live Birth, the legal ownership document for the body that is actually reading this, is once again held by the state.
Before you go on, I noticed that you keep italicizing "the state", why is that?
That's a great question. The legal definition of the word state is:
From the Montevideo Convention (1933)
"The state as a person of international law should possess the following qualifications: a permanent population; a defined territory; government; and capacity to enter into relations with the other states."
When I use the word state, I am referring to THE UNITED STATES, which is a municipal corporation (see 15 (A)(B)(C) here), chartered by the British Crown. Every time you see "the State of...", it is referring to a franchise of the United States Corporation. In 1871, the original "Constitution for the United States" was replaced with the "CONSTITUTION OF THE UNITED STATES". To get even deeper into this piece of the puzzle, not only is the United States simply a creation of the British Crown, but the British Crown is owned by the Roman Catholic Church.
...do offer and freely concede to God and His holy apostles Peter and Paul and to our mother the holy Roman church, and to our lord pope Innocent and to his Catholic successors, the whole kingdom of England and the whole kingdom Ireland, with all their rights and appurtenances...
In 1207, King John of England disagreed with Pope Innocent III on who the Archbishop of Canterbury should be, and refused to acknowledge the pope's choice. The pope responded by laying an interdict (religious strike banning marriages & christenings) on the Kingdom of England, and when that didn't work he excommunicated the King himself. In 1213, John wrote this concession to the pope, granting the entirety of The Crown to the Catholic Church.
Ok... I'm going to need to sleep on all of that. Didn't you say you were going to tell me how to get back ownership of my body?
I certainly did say that, here's the simple answer: Get your authenticated Certificate of Live Birth. This process takes just a couple of steps. First, get a certified copy of your COLB from the Bureau of Vital Statistics, or the County Recorder's office where you were born. Send that COLB to the Secretary of State's office for the state you were born in, with a form requesting an authentication (sometimes it will say "apostille", if so cross that out and write in authentication) & the required payment. You will get back that copy of your COLB with another form, attached with a seal. Take that and a form DS-4194, and send those documents & payment to the Secretary of State's office for THE UNITED STATES. After you get back that twice-authenticated COLB, you now hold an as-good-as-original copy of the ownership document for your body.
My Take
To be honest & transparent, I haven't gone through this process myself. I have friends who have, and it is really just one of many approaches that exist to separate oneself from the state. My personal approach is one of research (so I have the tools I need, or at least know where to look and what questions to ask), non-interaction (I don't use a SS#, legal name, banks, credit cards, etc.), and calmly jedi-ing my way out of interactions with a mix of knowledge, calm centered-ness, and the use of key words like sir.
I've written one other piece on this kind of material, covering the difference between traveling & driving, and how to interact with government road pirates. I'll be doing another deep dive all about taxes (and why nobody should or has to pay them) in the coming months.
The most important piece of research like this is that it allows us to know the spell that is being cast on us, so that we can remove it or remove ourselves from it's field of effect in whatever way feels aligned. In truth, as long as you beLIEve that someone else can have a right to control you, through any means, you can never experience freedom. Freedom is the state of responsibility for one's life, actions, and experience. To be free is the exact opposite of being a victim.
The great & terrible thing about the way that this illusion plays out is that it only exists in the mind. There are tons of books, papers, "laws" that say this or that, but those are all simply concepts simply laid out in a visible way. The only reason that the state has any power is because millions of humans surrender their own will to that fiction. Because people believe that the state has the right to steal their time ("taxes"), to commit genocide ("war"), and to kidnap people ("arresting"), the state is able to do those things without repercussion.

I must point out that there is a difference between our legal persons, which are the subject of political power, and our natural persons, which are inherently sovereign and free. In fact, as natural persons, we are not subject, citizens, nor slaves, and cannot be. This is proved inherent in us by virtue of our natural existence by the fact that no coercive power exists that can undertake to act as us. Whatever inducement or coercive force is applied is undertaken to get us to effect the desired action, and that action cannot be taken for us, but only at our sole option.
No matter what, we act only at our sole option. This cannot be severed from our persons. All the lawfare against free people - and this is basically the purpose of the state - is fraud. You cannot be property. You are not property. You are not owned - not even by your legal person! You are sovereign, and cannot be made to be otherwise.
This invalidates the very concept of legal person as fraudulent, because what person is defined as under every legal theory is not a natural person at all, but property. Persons are not property. This may sound like semantics, but it is simply exactly precise, rather than an inaccurate definition which allows person to be defined as property. It is not merely semantics, but an essential difference, and that difference is the entire basis for legal authority over sovereign persons claimed by overlords of every kind and stripe.
That authority over free and sovereign people cannot exist in the real world. It is a legal fiction, and a fraud.
When that distinction becomes clear, it is very obvious why most people aren't aware of it, and also why we are indoctrinated from birth to not be provided the linguistic tools and historical grasp to independently arrive at the basic truth: actual persons aren't, and cannot be, property, and all claims that persons can be property, subjected to slavery, liable to pay taxes, or the debts of others, are actual fraud. The state itself is a fraud, because it purports an ownership interest that cannot exist, and proceeds to act on that fraudulent claim, which is an inherently criminal act, and, indeed, a crime against humanity even if one argues that no harm is done, because it denies the natural and inherent sovereignty of all free people, and purports they are property.
There are ways to effect social organizations that are lawful in view of this real fact of our existence, but they are the weapons that defeat parasitic profiteers, and thus will be called crimes by unlawful states.
tl;dr you cannot own you, nor can anyone else, because you are sovereign, and that cannot be severed from you. All claims to the contrary are crimes, at least fraudulent, and generally are used to justify further crimes against humanity. This does not prevent us from effecting lawful government, despite claims of statists to the contrary. It only limits lawful government to those powers actually consented to by informed and natural persons.

The issue is that due to ignorance of the language, laws, and practices involved, the average human is tricked into thinking that they are subject to others. As long as someone goes around identifying themselves as that NAME, signing for the licenses & permits, paying the taxes, and obeying, they are actually giving their power over, they are subjecting themselves to, the state.
YES! And at the same time, back to my previous point: just because one cannot be owned doesn't mean that their experience of reality can't be that of being a subject, of being without freedom. The power of mind control is that simply convincing someone that ____ is true, they will end up experiencing reality as though it were true. This interview with Marshall Sylver (a world-renowned hypnotist) is a GREAT piece that gave me a whole new angle on the intersections of propaganda, mind control, free will, manifestation, and the experience of reality.

The state is simply a concept that masses have been trained to believe in, it doesn't exist. Except that in the fact that billions believe in this concept, it has form in the real world as well. The belief, the focus, the stories in the collective consciousness, all lead to the physical manifestation of those beliefs.
Unraveling those stories, changing people's core beliefs, those little changes, are really the key to collapsing the whole thing. This recent interview with Davi Barker covers some of this from a really powerful and pretty new angle. Taking away the sense of legitimacy has been shown to actually put those in power into a state of being hyper-critical of themselves.
Just like with holidays that people pour time & energy into, often without knowing what the ritual is, what the history, or anything else about it... My experience has been that when folks are introduced to the reality of what they're celebrating, it leads to big changes in how they interact with that day.
It's great that we both see these matters as they are.
Regarding the deinstitutionalization of 'the masses' I am confident that is going to happen, and as it does, then the words of philosophers and researchers into power and politics are going to matter more, particularly as they can be provided by honest people, rather than would be overlords and their mouthpieces. What is making this happen more and more today - besides the harm being done people that drives them to desperation daily - is decentralizing the means of production. As salaries and wages shrink, and prices continue to rise, being able to manufacture your own goods without suffering the parasitization endemic to extant political edifices will become ever more essential. As the price of owning the means of production continue to decrease, folks will adopt them.
As they realize how much better off they are as a result, their friends and neighbors will find out, and, once development has produced means of 3D printing and etc., that are easy enough to use, the spread of decentralized production will go viral. At some point, even the densest person will grasp that they were being parasitised, and this will likely be accompanied by ever more desperate efforts to parasitise them by profiteers losing their power.
I reckon this is a more rational mechanism to inform people of their freedom from overlords than mere words.

I think a point you may be missing is that nobody can force a contract on us AND it be enforceable in a legitimate court of laws.
I get that you want the specifics, and this post is the most concise recitation of those specifics I've seen, but the hillbilly in me says you can either contract with me legitimately, or you can use force.
The fact that the government only does things by force, or acquiescence to the inevitability of force, makes it illegitimate.
Combine that with 'well settled' SCOTUS rulings that the government has no duty to protect you, and there can be no citizens.
Citizenship being a duty of allegience in return for a duty to protect.

The bare fact is that there are no lawful courts. All law (except natural law, which courts do not recognize) I am aware of is based on the false definition of persons as property, and persons cannot be property, as we are actually sovereign by virtue of our actual and natural existence.

Is this 'natural law' the 'laws of nature', like gravity and such?
In the comment to the OP below, I explain better what I mean. The short version is failure to be kind to others, and to trangress such natural law is something even dogs will punish their ilk for. Dogs are a different species, and have different social rules and biological imperatives, making the natural laws of dogs different than those applicable to us, as well as on a completely different intellectual level.
That does however indicate what I mean by natural law, which can be ferreted out in specifics (for those that overintellectualize and ignore their gut feelings) by comparing various cultures and ascertaining those societal rules that are nearly ubiquitous, while usually being negated by some cultural feature or another in specific instances. I reckon that latter is caused by malicious parasites that pervert society - whichever specific society they exist in - for their aggrandizement.

I have read a lot about this but to be honest have not had the balls to do anything about it. I understand the principle but to actually do it is complex and could go wrong but this is what we are supposed to feel. Man I would love to look into this more I just don't have the time or energy currently. Maybe when I have bought my own land an a living more freely 💯🐒
Haha! Ya, it is a monolithic task to take on. Personally, I don't really think jumping through all their hoops is necessary. Knowing the truth of my own sovereignty, combined with a knowledge of their language and some basic tactics (in case I do have a run in with their privateers), has always been enough for me.
Land ownership is the one place where it does seem like some level of interaction is necessary. I'm looking at creating a land trust, and going through the process to get a land patent instead of the deed. The LP would of course be in the name of the trust itself.
I agree totally! As I have spoken before currently we have to live in the common society. As much I would love to completely withdraw it's not practical I don't have the capital and they have may it purposefully difficulty to live outside there setup. As you say I know I my own sovereignty and in my mind I am free. I have had encounters with the fancy dress enforcers and knowing some of their language have avoided there requests.
Would love to hear more about the land, something to talk about on my podcast 👍🏽. I too want to buy some land so I can set up my project a holistic mental health centre. In the UK without being a part of the system this is impossible. So to me living as close to the edge as I can is the best option. As I bring those around me to this edge when the hundredth monkey wakes this is when we can all break the ties together 💯🐒

I find some of this to be accurate, and a lot to be hyperbole and fearmongering. Leaps of logic and fallacies rule the day here. It's too bad, because some of the info is good, and it's an important topic indeed.
I'm curious if you could give any examples of any of those things? Certainly I have no fear, and see my message as being one of empowerment, knowledge, and stepping away from the fear that almost every American lives in, with their hearts immediately racing when they see those red & blue lights.
