How is an executor determined if there is no will?

Even if someone passes away without a will, their estate will still need to be sorted out. An executor is given significant legal power and responsibility over the estate. They will work with the courts to determine the legal side of the matter is properly handled. Because of the high level of responsibility, time consumption, and work, executors are usually paid for their work at an hourly rate as determined by the local courts.

Usually, an executor is specified by the deceased in their will, but what happens when there is no will? Or an executor is not specified?

This Learn About Law video and article explain how an executor is chosen without a will. Attorney Kevin O'Flaherty will use his experience and knowledge as a lawyer to simplify the complex topic in both video form and a written article.
