The Korean Labor law being amended in 2018.

I can help you guys solve the troubles related labor law in korea.

Today, I'm going to write about the acts related labor law being amended in 2018

A. The Accident During Commuting.(출퇴근재해)

[BEFORE]

  • Only the accident during commuting under the control of employer is recognized as an industrial accident.

  • Only the accident during commuting by the means offered by employer is recognized as industrial accident.

[FROM 2018]

The accidents during commuting is recognized as a industrial accident.

  • Regardless of the means of commuting, all the workers who has an accident during commuting normally can be compensated by Industrial Accident Insurance.
    (enforcement Date 2018. 1. 1.)

  • The coverage will be expanded to the accident during commuting by various means like public transportation, a private car, bicycle, and on foot, etc.

  • Any worker who has an accident during commuting by a private car can be compensated by both Industrial Accident Insurance and private car insurance.

B. Paid leave.(연차유급휴가)

[BEFORE]

  • Any worker who has worked for less than 1 year shall not be granted paid leave, but shall borrow 1 paid leave from 15 paid leave for next year each month without absence.

[FROM 2018]

  • Because LSA (Labor Standard Act) article 60. 3. is repealed now, any worker shall be granted(not borrow) 11 paid leave in his/her first year, 15 paid leave second year(enforcement Date 2018. 5. 29.)
  • Thus, any worker who has worked for not less than a year shall be granted 1 paid leave in case that s/he has worked a month without absence. So, workers shall be granted maximally 26 paid leave for 2 years.
