WHAT IS SUMMONS? WHAT SHOULD I DO IF SUMMONS COMES?

If anyone receives summons from the court, they trembled from that no matter whether in that summons he/she is given instructions to produce in court as witness. Sometimes people don't receive summons as they feels that if they receives it, they can be in trouble. But that's not the Good thing. You must receive summons and go to court for helping the Court as witness relating to that matter. If you didn't receive summons, you can be in trouble for sure.

WHAT IS SUMMONS?

A summon is a legal document issued by a Court or by Administrative Agency of Government for the various legal purposes. Police writes the statement of witness under Sec. 161 of CRPC. In any criminal case if Police makes any person a witness, then they record the statement of that person and made him witness in that case by taking signature of witness on that statement. When trial started the Court calls every witness one by one by issuing summons against them. On the summons it is mentioned that the person is called by Court only as a witness, on such matter and also date of appearing. Person must receive such summons and should go to court on the mentioned date for giving his statement.

LET'S TALK ABOUT WHAT HAPPENS IF U DIDN'T TAKE SUMMONS?

Summons is send to the person for his appearance in the court and if person didn't receive summons, then summons is again send to such person. If person is not appearing in the Court after receiving or ignore summons issued by Court and the statement of that person is important for the Court, then warrants is issued for that person by Court. If Person is not appearing in the Court, he must have sufficient reason for doing so and he has to write letter in the court by giving his reason for not appearing in Court. If their is no sufficient reason for such, then a Non-Bailable warrant is issued against him. Such person is liable under the Sec. 174 of Indian Penal Code under which person is punishable with 6 months imprisonment or fine of Rs.1000 Or with both. The reason given for not appearing in the Court by the witness must be proved by him. The behavior of Court is very lenient towards such Govt. Witness and Court is of opinion that they must be free only in one or two visits. And if summons is related to Traffic Challans in such situation also the person has to appear in the Court on time.
