Welcome to the PAquarium’s web site or mobile application (as the case may be). This platform is operated by Quantum Group OÜ (Reg. No. 14220024) and has been created to provide information about our company, product and ideas. Our online platform is designed for use as a fundraising campaign to accept monetary donations and to offer our related services to our service users and visitors – to you.
Who we're not
We are not a broker, financial institution, charitable institution, credit institution, creditor, credit intermediary, insurance company, insurance intermediary, fund management company, investment and pension fund, investment firm, issuer of securities, e-money institution, payment service provider, an SME, nor considered as a qualified investor.
Who we are
We are a donation-based crowdfunding organization and PAquarium is administrative platform used solely for fundraising for the world’s largest aquarium project. PAquarium facilitates the donation transaction. The platform allows anyone to make a donation towards the construction of the world’s largest aquarium.
Who you can be
You can become a messenger of PAquarium. To finance the construction of the aquarium we are using the financial plan that is based on the idea of spreading idea around the globe. Every person can share an idea and invite others to register and donate. Every messenger earns a commission fee from donations of his followers. There are no limitations. Every person can attract an infinite number of followers.
Why are we saying this
At the moment of first donation, or registration on the platform’s user system, you become a services user and therefore agree to PAquarium terms and conditions. When using PAquarium platform, you will be subject to any additional terms applicable to such services that may be posted on the homepage from time to time, including, without limitation, the PAquarium privacy policy and PAquarium guarantee policy. All such terms are hereby incorporated by reference to these terms (provided, however, that such other terms may be modified in accordance with their terms and, with respect to the use of the services, these terms and conditions will take precedence in the event of conflict).
About agreeing to donate
Every user donates to the aquarium construction willingly and in good faith, thus affirming their belief in the PAquarium idea. You acknowledge that your participation in the project is voluntary and that you will not receive financial compensation, returns or refunds if the project is not successful.
The sum required for the aquarium construction is estimated approximately. The total estimate is around 1 billion dollars. We do not guarantee that the project will obtain a certain amount of donations or any donations at all.
What if we succeeded
If the project succeeds, the required money will be collected, the aquarium will be built, and PAquarium will grant a lifetime entrance ticket to every user who has donated 108 or more dollars over the period of three years from the moment of the first donation. The lifetime entrance ticket ensures that the user has a lifelong access to the aquarium. This means that, after completing the total donation, the user has the right to visit the aquarium as often, and for as long as they want, in compliance with the working hours and the terms of use of the aquarium. Every ticket owners name will be depicted on the wall of honor in the constructed aquarium.
It’s a long term run
When transferring the first donation to the aquarium, it is advised that the user agree to a monthly, automatic withdrawal of 3 dollars from a designated bank account. By agreeing to the deduction of an automatic payment, the user agrees to a monthly withdrawal of 3 dollars from their account, for the period of three years from the moment of the first donation (for the total donation of no more than 108 dollars). The automatic donation for construction of the aquarium is deducted once a month, on the same date of the month as the initial donation. It is the responsibility of the user to ensure that, on the required date, their bank account has enough funds to complete this transaction.
The user has the right to stop the process of automatic donations. This can be done by informing the service provider (bank) about the discontinuation of the automatic payment or on the user’s PAquarium profile. By making the initial donation, the user agrees that, in case they discontinue their participation in the project during the duration of the agreement, the sum of the monthly payments will not be returned to the user. In this case, the money will go towards the construction of the aquarium, in accordance with the financial division of the project.
About every 3 dollars
From every 3 dollars donated by the users, 1 dollar will be directed to the PAquarium fond (these funds will be used towards the construction of the aquarium, and all related expenses), 1 dollar will be directed to the PAquarium affiliate program (these funds will be will be given back to PAquarium messengers), and 1 dollar will be directed to cover administrative costs of project.
What if we fail
In case the construction of the aquarium has not begun by February 20, 2020, the collected donations from PAquarium fond will be directed towards charity.
Account registration and use
By making the first donation, the service user is automatically registered as a user of the platform and recieves a temporary password to users registered email address.
Everyone can become a registered user of the platform – no donation is required. Registration can be completed on the My account section on the platform. Users under 18 years of age are not eligible to use the services without parental consent.
If you choose to register as a services user, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by the registration form. You must register using your true identity, including your name. By registering, the user confirms the validity of the provided data and takes full responsibility for their accuracy. PAquarium is not responsible for the validity of any information given or otherwise provided by the user.
All information submitted in connection with a user account on the platform must be accurate and truthful. Users agree to notify PAquarium immediately if their user account has been used without authorization or if there has been any other breach of security of the user account. Each user also agrees to provide additional information that PAquarium may reasonably request and to fully and truthfully answer any questions PAquarium might ask the user in order to verify such user’s identity. Registration data and certain other information about the user are governed by our Privacy policy.
The user can access their user account by accessing the My account section of the platform. The user has the responsibility to not divulge their access data to any third party. You are responsible for maintaining the confidentiality of your password and account, if any. You are fully responsible for any and all activities that occur through the use of your account or password. You agree to immediately notify PAquarium of any unauthorized use of your password or account or any other breach of security, and ensure that you will sign out from your account at the end of each session when accessing the services. PAquarium will not be liable for any loss or damage arising from your failure to comply with this section.
On user profile, the user can view their unique link, manage the financial funds they have gained through the project, manage their followers and become a project messenger.
Login to your PAquarium account and spread your unique link through social media.
You’ll get paid one half dollar for every 3 dollars your friend donates for a Plankton’s house.
Withdraw money to your bank account.
Inviting friends
Every user can become a project messenger and gain financial revenue from the project. Profits can be made by inviting others.
After registration you will receive your unique link. All you have to do is share your unique link through social media, blog or email. You’ll get paid 0.50 dollars and more for every 3 dollars your followers donates for a PAquarium. Everyone who registers on PAquarium by using your link will be your follower.
By making a donation, or registering on the platform, the user is required to create a username. The user agrees to the publication of their username, for the purposes of the project. Everyone who registers on PAquarium by using your username will be your follower.
Money withdrawal
The user can manage the financial funds they have gained during the project on their user profile. These funds can be transferred to their bank account, or donated to the PAquarium funds, by completing the money transfer form on the Withdraw section of their user profile. The minimum amount that can be transferred to the user’s bank account is 20 dollars. The commission fees of this transfer are paid by the user.
PAquarium is responsible for transferring the requested revenue to the user’s bank account within 10 working days from the time of receiving the request of withdraw. The users who, after registering on the platform and becoming messengers, have not made a donation, can transfer their earnings to their bank account only after they have completed the donation for the amount of months that correspond to their time as an active user. To transfer the money to their bank account, the messenger has to make a donation for each month since the registration of their first follower.
Permission to send emails
By making a donation, or registering, the user is asked to indicate an email address. The user agrees to receive news and other project-related information at the email address. If the user has registered through social networks, the information is sent to the email address provided by the corresponding social network.
Use of personal data
By making a donation, the user agrees that their personal data is included in the PAquarium data base. PAquarium has the responsibility to not divulge any of the user’s personal data to a third party, with the exception of ensuring a successful payment transaction and cases where the user has agreed to the publication of their personal data. By making their first donation, or by registering on the platform, the user agrees that, after completing the total donation of 108 dollars their name and last name will be included on the list of supporters of the project.
Taxes and responsibility
PAquarium does not hire, employ or create any other bonds of employment with the project messengers. PAquarium only conducts the administration of the donation-based crowdfunding project, ensuring its realization and providing the service user with a user profile used to further the project idea and attract followers.
Every user is fully responsible for any information included in their user profile, as well as any information they send out to others. The user accepts full responsibility for the consequences of publishing and delivery of this information.
You agree that you are solely responsible for your interactions with any other user in connection with the services and PAquarium will have no liability or responsibility with respect thereto. PAquarium reserves the right, but has no obligation, to become involved in any way with disputes between you and any other user of the services.
The service user, who has become a messenger, undertakes full responsibility for the legalization of the financial funds they have gained during the project. The user, who has become an agent, has to register as a taxpayer, in accordance with the normative acts of their respective country. The service user is personally responsible for the payment of taxes for the funds they have gained from the project.
Fake profiles and frauds
In cases where the service user is suspected of creating false user profiles, participation in fraud or endangerment, PAquarium reserves the right to, without prior notice, exclude service users from further participation, and to limit or deny their access to their user profile, for a limited time, or permanently (including access from particular IP addresses), without explaining the reasons for exclusion. If the service user has had their access limited or denied, or if this user account or profile information has been deleted, then the service user is not subject to any refunds or payments. In any case arising, PAquarium reserves the right to refuse use of the services to anyone and to reject, cancel, interrupt, remove or suspend any user of services at any time for any reason without liability.
You agree that PAquarium, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of the services and remove and discard any content within the services under reasonable circumstances, including, without limitation, for lack of use or if PAquarium believes that you have violated or acted inconsistently with the letter or spirit of these terms and conditions. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of services, may be referred to appropriate law enforcement authorities. You agree that any termination of your access to the services under any provision of these terms of service may be effected without prior notice, and acknowledge and agree that PAquaruim may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the services where such deactivation or deletion is permitted under these terms of service. Further, you agree that PAquarium will not be liable to you or any third party for any termination of your access to the services.
Other rules
These terms and conditions constitute the entire agreement between you and PAquarium and govern your use of the services, superseding any prior agreements between you and PAquarium with respect to the services. You also may be subject to additional terms and conditions that may apply when you use affiliate or third-party services, third-party content or third-party software.
Your use of the service is at your sole risk. PAquarium and its services users make no warranty or condition that the aquarium will meet your requirements, the service will be uninterrupted, timely, secure or error-free, or that the quality of the aquarium will meet your expectations.
The service user clearly understands and agrees that neither PAquarium nor the service users are responsible for any direct or indirect, incidental or intentional damages to the non-acquired profit for the duration of the project, as well as services user’s inability to use the lifetime ticket.
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the services (submissions), provided by you to PAquarium are non-confidential and PAquarium will be entitled to the unrestricted use and dissemination of these submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
PAquarium is not a place for hatred, abuse, discrimination, disrespect, profanity, meanness, harassment, or spam. Do not use the services to promote violence, degradation, subjugation, discrimination or hatred against individuals or groups based on race, ethnic origin, religion, disability, gender, age, veteran status, sexual orientation, or gender identity; post images or videos that are sexually explicit or post links to sites that contain sexually explicit material or show people or animals being hurt or degraded; spam the comments sections or other users with unsolicited or unauthorized offers of goods and services, advertising, promotional material, junk mail, spam or chain letters, or inappropriate messages; engage in any activity that interferes with or disrupts the proper working of the Services or any activities conducted on the platform; run any form of auto-responder or spam on the platform.
Do not use manual or automated software, devices, or other processes to crawl or spider any page of the site, take any action that imposes, in PAquarium’s sole discretion, an unreasonable load on PAquarium’s infrastructure, or represent products created by others as your own creation, or act as a reseller of others’ product.
All of the intellectual property rights to the website platform belong solely to PAquarium. In case these rights are breached, the guilty party shall be prosecuted in accordance with the normative acts, and is likewise fully responsible for all of the losses that have affected or might affect PAquarium.
At PAquarium, we respect the privacy of our users. For details please see our Privacy Policy. By using the services, you consent to our collection and use of personal data as outlined therein.
All disputes between PAquarium and the service users are resolved through negotiations. If any disagreements or arguments between PAquarium and the service user are not resolved through negotiations within 30 days after the submission of a written notice, the disagreements are dealt with in the order mandated by the judicial acts.
