All executive power is vested in the president per Article 2 of the constitution. This means that a subordinate to the president cannot indict the president--this would have the effect of allowing a coup. But there is a simple solution that the framers built into the system. Impeachment!
Nothing would stop a local jurisdiction from indicting a president for murder. But someone who reports to the president cannot co-op presidential authority by indicting his/her boss.
