Section 102 Assault -- Penalties.
Effective 5/12/2015
76-5-102. Assault -- Penalties.
(1) Assault is:
(a) an attempt, with unlawful force or violence, to do bodily injury to another; or
(b) an act, committed with unlawful force or violence, that causes bodily injury to another or creates a substantial risk of bodily injury to another.
(2) Assault is a class B misdemeanor.
(3) Assault is a class A misdemeanor if:
(a) the person causes substantial bodily injury to another; or
(b) the victim is pregnant and the person has knowledge of the pregnancy.
(4) It is not a defense against assault, that the accused caused serious bodily injury to another.
From the Salt Lake Tribune - "Salt Lake City Mayor Jackie Biskupski announced Wednesday that an internal affairs investigation of two Salt Lake City Police officers involved in the July 26 arrest of a University Hospital nurse found a number of policy violations occurred, including conduct unbecoming of a police officer, courtesy and arrest policy."
It's clear to me (And If I were impaneled on a Jury, I would vote guilty from viewing the video) that ""Officer"" Payne is guilty of a class B Misdemeanor, which according to Utah State Law, carries a 6 month Jail sentence, and a $1,000 fine.
