Put JUSTICE here and put JUDGMENT there, look at in between, we have a devil in the detail.
There naturally will be devil in the detail, and because if one look at what Justice means and also look at what Judgment means, one will know that both Justice and Judgment cannot be completely detached from any environment.
The Jurisprudence of justice gives you so many schools of thought. We have the NATURAL SCHOOL, the EGALITARIAN school , the UTILITARIAN SCHOOL, the WELFARISM SCHOOL of justice, and each one propounding what it feels as its Dynamics , and what it feels should be justice ,and generally justice has to do with the thinking of the people, because justice is not in isolation of the history , the culture ,and the faith , and the histrionics of the people and where all those is put into context , the judge who finds himself or herself in the position of dispensation of that justice would naturally operate from the environment.
Then the world also has come to a stage where we say the world is one because it has become so globalised that justice in one place should be justice in another place, and that’s why it is said that “injustice against one is injustice against many”, so now it has reduced the flanks of divert definition of justice, now justice as simply come to become the way of doing things in the way and manner that is fair , in a manner that is equitable and in a manner that is good to all , and in other to do this , judgment must always be able to consider Fairness , Equity and Goodness to all.
Justice itself must be in confident , people must have confidence in the system that provides justice and public perception sometimes , do not really detect the decisions of court and there has always been this debate on the nexus , the link between what is called Substantial Justice and what is called Technical Justice. Whereas technical justice in its elementary terms, basically entails adherence to strict principles of law , strict provisions laws , what some lawyers will call dry letters of the law .Where a judge notwithstanding the outcome , notwithstanding the effects his decision will have on the society goes ahead to interpret the law in the language that is literally.
