RE: Watch 'Terrorist Propaganda' and Go to Jail

Despite historically strong traditions of decentralization of government, checks and balances, constitutionalism (in the USA) and a strong emphasis on rule of law, I'm baffled as to increasingly hear about this type of infringements on the basic principles on which societies are built in the Anglosphere. Am I not understanding something about English Common Law? Is there such a reliance on the judicial system as a branch of government to uphold the rule of law according to tradition that law-making can be allowed to be this weak?
