I do not file income tax returns! I researched the IRS Code, Supreme Court decisions, the Constitution, the Federal Register and reams more evidence and came to the undeniable conclusion that our government is collecting income tax without legal authority. Truth more amazing than fiction even as the IRS, itself, proclaims the whole deal is based on "voluntary compliance." And since the illegal enforcement of income tax law is causing immeasurable damage to our Republic, I have no choice.
The April 1998 U.S. Attorney's Bulletin 19 describes our Justice Department's strategy to incriminate citizens who rely on a Supreme Court decision. "One defense that must be carefully handled is the 'good faith' defense, which is used to refute willfulness. In the seminal case of Cheek v. U.S. (1991) the Supreme Court ruled that a taxpayers 'belief' that he or she is not required to file, however incredible such a misunderstanding of and beliefs about the law might be, does not have to be objectively reasonable. Rather, the standard is a subjective one.
In an attempt to present a good faith defense, most illegal tax protesters will attempt to introduce the Constitution, the IRS Special Agent's Handbook, various court decisions, protester publications, as well as other documents. To limit or prevent an illegal tax protester from introducing these documents into evidence, consider arguing that" …there follows a number of suggestions.
Meanwhile, where the fuck did innocent until proven guilty go? The Justice Department is judging a citizen "illegal" before the court does. It readily admits that a citizen's sincere belief that he or she is not required to file, legally correct or not, is absolute defense for not doing so. Then our Justice Department, nevertheless, accuses those who rely on the law "illegal tax protesters." There is no mention that Cheek v. U.S. bestows a citizen with legal rights that are to be enforced. Instead, these rights are disparaged as "incredible misunderstandings." Reading further the Justice Department portrays cases that rely on Cheek v. U.S. as "patently frivolous," "bizarre" and "often provides great stories."
Which Cheek is doing at this very instant, as it reveals the depth of our oppression. While I believe my defense (https://steemit.com/anarchy/@twelfthman/citizen-defies-irs-for-a-decade) proves, beyond a reasonable doubt, that I am not required to file an income tax return, along comes Cheek v. U.S., thus it is a law of this land, that I need not be legally correct. I need only possess a sincere belief. As I have revealed why, as my actions have proven, as witnesses will testify, as I swear to, I have a good faith belief that I am not required to file, thus my failure to file is “not willful.” As any citizen's would be... if he or she sincerely believed this treatise and refused to volunteer.
The Establishment, the "Deep State" that holds America in bondage is being exposed, look no further than NSA spying, in absolute contradiction to our Constitution. The IRS is also the very essence of the "Deep State." It is also lawless, bestowing more and more wealth upon the rich and powerful. For America to fulfill it's vision we must end this travesty as it is destroying our nation. If our tax system is corrupt, all else follows.
