OVIEDO, Fla. (AP) – A Florida man spent 90 days in jail after police officers who stopped him for driving without headlights said white powder found in his car was cocaine.

But Karlos Cashe walked out of jail last week after lab results determined the powder in the handyman’s car was actually drywall.

Cashe tells WFTV he repeatedly told officers in Oviedo the substance was drywall. But after running a check they found he was on probation for marijuana and cocaine charges in 2015. Cashe says a K-9 alerted on his vehicle and an officer’s field test was positive for cocaine.

Court records show he was denied bond because he was accused of violating probation.

It took nearly three months for lab test results, which were negative for cocaine.

It's a lesson to not get on the police's radar, if he had no prior history, they would have probably given him the benefit of the doubt. People with criminal records really have to stay sharp and avoid misunderstandings.

Yes but the law regarding drug use is quite stupid. You shouldn't have a criminal record for drug use

Unfortunately, drug use can too often lead to dealing, which is a violent business because of the money it brings in. With money, there is power and with power there is violence when it is threatened to be taken away.

That's why it would be better for drugs to be legalised and regulated

I just don't see how that could work in society in general. Drug use is already banned from any type of job so the only people taking it would be the elderly or the non working class. Drug use is also dangerous when over used. Look at the medical industry, the drugs it produces are abused and lead to a poor quality of life and many overdoses.

Putting people in prison for drug use makes things worse. Even if they aren't legalised, they should at least me decriminalised like they are in Portugal, where they treat addiction as a health issue rather than a crime.

Plus, drugs such as marijuana, magic mushrooms and LSD are safer than alcohol. And from what I've researched, cocaine isn't much worse than alcohol or cigarettes in moderation. So just because some drugs are illegal, doesn't mean they are any better than legal drugs.

Strictly speaking, this was not an offense at all, but having a criminal record suddenly made the drywall something suspicious. Especially when you are without headlights, which might make the police think you are trying to hide.

The district courts are likely to grant qualified immunity on grounds that the cop had qualified immunity on grounds that in the false arrest case the police had probable cause (and certainly above the lesser standard of arguable probable cause, which In the 11th circuit (fl, ga, al) recognizes immunity to gov't officials). An invention made in the last 35 years or so that basically gives cops a go ahead to bully-even kill- just about anyone they please. It is the courts way of gutting civil rights laws of their teeth, and running afoul of international treaties (see iccpr art 2(3) and 9(5)).
This could happen to you, your kids, or your kids, your friends-It needs not even be about alleged drugs (which have included dried spaghettios, and vitamins)-but may very well include protected speech. Talk to your congressman about ending qualified immunity and that your right to seek a redress of grievances against abuses of government are an enforceable right in the court as they were since the Magna Carta until this modern era.

And how easy would it be for a police officer to snort the powder to see if it's cocaine? They need to investigate drugs properly before they charge. Would be better if they didn't charge for possession though.

Three months for lab results is ridiculous.

At the federal level a judge could issue a summons instead of an arrest warrant, but municipalities love the arrest warrants because forcing ppl to plead guilty raises money for them. The delay is just long enough to ensure that a person stays locked up long enough to plead guilty, over 95% of criminal cases result in a plea deal. No such thing as a fair trial in the usa anymore.
