The fact that it was a 12 year old is irrelevant and just an play on emotions. If it was an accident and also not due to negligence then no, no criminal act has occurred. I'm sure civil suits will follow in both cases but that's different.
However, if you shoot a police k9, in the eyes of the law it is effectively shooting a police human. He is quite lucky to be alive to be honest
